1. Purpose and scope
This policy applies to copyright concerns involving products, listings, content, accounts, and other material available through RacerServices.com. A complaint is an allegation, not a final legal determination. Receiving a notice does not establish infringement, and a submission is not necessarily complete or legally valid merely because it was sent through this page.
Racer Services LLC may consider the Digital Millennium Copyright Act, other applicable laws, contractual rights, available evidence, and the circumstances of each matter. Nothing in this policy guarantees safe-harbor protection or provides legal advice.

3. Requirements for an infringement notice
A copyright-infringement notice should include the copyright owner's or authorized representative's physical or electronic signature; identification of the copyrighted work claimed to be infringed or, for multiple works at one site, a representative list; identification of the allegedly infringing material and information reasonably sufficient to locate it; contact information reasonably sufficient to reach the complaining party; a good-faith statement that the disputed use is not authorized by the copyright owner, its agent, or law; and a statement that the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner.
4. Identifying and locating disputed material
Provide the exact product, listing, page, URL, account, or other location for each allegedly infringing item. Describe what material is disputed and how it relates to the protected work. General references to an entire website, search result, seller catalog, or category may be insufficient when more precise information is reasonably available.
5. Required statements and signature
The notice form requires good-faith, accuracy, authorization, signature, and penalty-of-perjury statements. A typed name may serve as an electronic signature when submitted with the intent to sign. The submitter must also acknowledge that relevant information may be shared with an affected party.
6. Review and possible action
RacerServices may review a notice for completeness, apparent validity, specificity, authorization, and consistency with available information. Depending on the circumstances, it may request clarification, preserve evidence, temporarily restrict material, remove material, disable access, decline to act, or take another reasonable step. No particular action is automatic or promised.
7. Notice to an affected seller or user
Where appropriate and legally permitted, RacerServices may notify the affected seller or user and provide relevant notice information so that person can understand the allegation and respond. Contact or identifying information may be withheld or limited when reasonably necessary for safety, privacy, fraud prevention, legal compliance, or another legitimate reason.
8. Counter-notification requirements
A counter-notification should include the subscriber's physical or electronic signature; identification of material that was removed or disabled and its former location; a statement under penalty of perjury that the subscriber has a good-faith belief the material was removed or disabled because of mistake or misidentification; the subscriber's name, address, and telephone number; the required federal-court jurisdiction consent; and consent to accept service of process from the original complaining party or its agent.
9. Jurisdiction and service of process
A counter-notification must consent to the jurisdiction of the United States Federal District Court for the judicial district in which the submitter's address is located. If the address is outside the United States, the submitter must consent to the jurisdiction of any United States judicial district in which Racer Services LLC may be found. The submitter must also agree to accept service of process from the party who submitted the original notice or that party's agent.
10. Potential restoration after a counter-notification
After receiving a counter-notification that RacerServices determines is valid, RacerServices may send a copy to the original complaining party. Subject to applicable law, the material may be restored or access re-enabled not less than 10 and not more than 14 business days after receipt of the valid counter-notification unless RacerServices receives notice that the complaining party has filed a court action seeking to restrain the allegedly infringing activity, or another legal, technical, contractual, safety, or evidentiary reason prevents restoration.
11. Misrepresentation warning
Knowingly materially misrepresenting that material is infringing, or that material was removed or disabled through mistake or misidentification, may create liability under applicable law. Fraudulent, abusive, or materially false notices and counter-notifications may also lead to rejection, account restrictions, or other appropriate action. Consider obtaining independent legal advice if you are uncertain about your rights or statements.
12. Repeat-infringer policy
RacerServices maintains a policy of terminating, in appropriate circumstances, accounts of subscribers or users who are repeat infringers. Decisions may consider valid complaints, responses and counter-notifications, court decisions, admissions, patterns of conduct, the seriousness and recency of conduct, and other reliable evidence. One allegation does not automatically prove infringement or require termination.
13. Serious conduct, evasion, and related accounts
RacerServices may take proportionate action concerning serious or willful infringement, fraudulent notices, attempts to evade restrictions, misuse of related accounts, or repeated valid complaints. Possible actions include investigation, content restrictions, listing removal, suspension, or account termination, but no outcome is automatic. Related accounts will not be treated as responsible solely because they are related; the available evidence and circumstances matter.
14. Standard technical measures
RacerServices accommodates and does not interfere with applicable standard technical measures used by copyright owners to identify or protect copyrighted works when those measures satisfy applicable legal requirements and are reasonably available to the service.
15. No general monitoring promise
RacerServices does not undertake a general obligation or promise to monitor every product, listing, file, message, or communication for possible infringement. It may use human review, technical controls, reports, or other reasonable methods where appropriate without representing that all infringement will be detected or prevented.
16. Records and disclosure
RacerServices may retain notices, counter-notifications, related correspondence, account actions, and supporting evidence for operational, evidentiary, fraud-prevention, dispute, and legal purposes. Relevant information may be disclosed to affected parties, legal advisers, service providers, courts, government authorities, or others where reasonably necessary or legally required. Do not submit information unrelated to the complaint.
17. Non-copyright complaints
The DMCA process is intended for copyright claims. Trademark, privacy, impersonation, fraud, security, contractual, and other concerns may require different facts and procedures. Send general seller or product-support concerns to support@racerservices.com. RacerServices may redirect a submission to an appropriate process.
18. Contact and policy changes
Formal copyright notices and counter-notifications should be directed to the designated agent at admin@racerservices.com or the mailing address above. RacerServices may update this policy to reflect legal, operational, or service changes. The effective or last-updated date identifies the published version.
